المتهم لايكون مكلفًا بدفع اتهام جنائى إلا بعد أن تقدم النيابة العامة بنفسها ماتراه من وجهة نظرها إثباتًا للجريمة التى نسبتها إليه، لينشأ بعدئذ للمتهم الحق فى نفيها ودحضها بالوسائل التى يملكها قانونًا.
