اختصاص– مبدأ عدم جواز تسليط قضاء إحدى جهات القضاء على قضاء جهة أخرى
الحكم بعدم الاختصاص والإحالة إلى محكمة النقض أو المحكمة الإدارية العليا يترتب عليه مخالفة الأوضاع والمواعيد والإجراءات وحالات الطعن المقررة أمام هاتين المحكمتين، فضلا عما ينطوي عليه هذا الحكم من إهدار حق التقاضي أمام أكثر من درجة– هذه الإحالة غير جائزة.
